Court Decision Upholds New Rules For Rail and Aviation Union Elections

WASHINGTON, DC – Edward Wytkind, president of the Transportation Trades Department, AFL-CIO, issued the following statement today in response to a decision in the United States District Court for the District of Columbia, rejecting the Air Transport Association’s attempt to overturn new National Mediation Board (NMB) rules governing union elections:
“With today’s court decision, tens of thousands of airline and rail workers are a step closer to pursuing the power of collective bargaining under fairer union election rules.
“The deck has been stacked against workers for too long with many union elections being invalidated by unfair rules that required super majority participation – a standard found nowhere else in our democracy.  The new rules put an end to the practice of counting all non-voting employees as ‘no’ votes.
“We look forward to the new NMB rules going into effect without further delay.”
